It is the end user's responsibility to consult this documentation to be certain that their usage habits conform to the ideals outlined in this policy document.

All Cable Internet services offered by CityWest Cable & Telephone Corp. will be subject to the ideals outlined within this Acceptable Usage Policy.

CityWest Cable Internet access service know as, Cable Internet will allow the users to join a worldwide network. Because of the number of users utilizing the services we believe that the services must be divided equally among these users.

By signing the Acceptance of Installation and Services agreement at the time of installation you are accepting all of the terms outlined in this Acceptable Usage Policy. You are also accepting all responsibility for the account including activity and payments. IF YOU DO NOT AGREE WITH ANY OF THE TERMS OUTLINED WITHIN THIS DOCUMENT OR THE EXTENDED VERSION OF THE SAME LOCATED ON THE WWW.MONARCH.NET WEBSITE, DO NOT SUBSCRIBE TO THIS SERVICE. IF YOU ARE A CURRENT SUBSCRIBER AND DO NOT AGREE WITH THE TERMS OUTLINED WITHIN THIS DOCUMENT, YOU MUST CONTACT CITYWEST CABLE IMMEDIATELY TO TERMINATE YOUR SERVICE.


1. Illegal Activity

Any use of the Cable Internet service for activities that Provincial, Federal or International law, order or regulation would deem as illegal is a violation of this policy and is strictly prohibited.

Prohibited activities include but are not restricted to:

Posting or distributing material which is unlawful (child pornography or obscene material).
Distributing material which is explicitly copyrighted.
The customer assumes all risk regarding whether material is in the public domain
Participate in illegal soliciting schemes (pyramids, etc.)
Participate in fraudulent activities including but not restricted to impersonating any individual or entity, forging another individual's digital or manual signature.


2. Security

The customer is ultimately responsible for all activities which stem from the use of their account. This includes activities committed by friends, family, guests or anyone with access to the customer's account. If the customer has sufficient reason to believe that undesired others have access to their account and can prove these actions they must notify CityWest Cable & Telephone Corp. immediately.

Because the Internet has a worldwide audience some material distributed via this medium may be deemed offensive or not be in compliance with the local laws or regulations in your area regarding items including pornographic material or hate literature in particular when dealing with minors. CityWest Cable & Telephone Corp. systems accepts no responsibility for content that is available via the Cable Internet services. The customer accepts all risks when accessing content using the Cable Internet services and CityWest Cable will not be held liable for any and all claims, losses, actions, damages, suits or proceedings related to but not limited to access of such content. Parents are responsible for the actions of their children in relation to inappropriate material and are responsible for the purchase of Parental Control Software or the monitoring of children while utilizing the Cable Internetservices. Complaints or concerns should be directed to the individual site or content provider.

The customer is responsible for any material that is posted to the Internet via use of their account. CityWest Cable & Telephone Corp. reserves the right to remove any information or materials in whole or in part that it, at its sole discretion has deemed to be offensive, indecent, or inappropriate.

CityWest Cable & Telephone Corp. reserves the right to monitor content and disclose the same in accordance with your Service Agreement. By using the services to distribute, transmit, or post material, the user is validating that the content complies with the guidelines outlined in this agreement and that the material may be displayed and distributed worldwide.

The Cable Internet service may not be utilized to breach security of another user, or attempt to access the resources of anyone's computer without knowledge of any consent by the accessed computer's user. The services may also not be used to utilize security-compromising tools such as password guessing programs, cracking tools, packet sniffers or network probing tools to gain access to unauthorized accounts with the intent of accessing data not intended for the user.

The services may not be used in any way to disrupt the services of another user. Attempts to interfere with computer networking, telecommunications services, host or network including but not limited to denial of service attacks, flooding of the network, overloading a service, and improper obtaining of and abuse of operator or administration rights or attempts to crash a host. The transmission or distribution of any software that contains a virus or feature with the intent of causing harm to another system is explicitly prohibited.

The customer is responsible for the security of any devices connected to the Cable Internet service, including data. CityWest Cable & Telephone Corp. also does not recommend enabling file or printer sharing as it will make you visible to other users. Any devices or data that you make available for remote access should be password protected.


3. Inappropriate Content

4. Electronic Mail

The Cable Internet services may not be used to send unsolicited bulk or commercial messages. These messages may be sent only to those receivers who have explicitly requested it.

Forging, altering or removing electronic mail headers is prohibited. However, you may insert additional characters into your from: and reply-to: addresses in order to prevent your true address from being automatically added to the mailing lists used by bulk e-mailers. In this case, your true address must remain obvious to any human viewer. For example, you may substitute nospan.john.smith for john.smith.

You may not reference CityWest Cable & Telephone Corp. or the service of Cable Internet or list an IP address which belongs to CityWest Cable & Telephone Corp. in the header of any unsolicited email, even if the email is not sent through Cable Internet.

Mail Bombing is prohibited. You may not utilize the services of Cable Internet to send numerous copies of the same or substantially similar messages. You may not also send a very large message or files to a recipient with the intent of disrupting the Cable Internet service or an account. The propagation of chain letters is prohibited whether or not the recipient wishes to receive the mailings of this nature.

CityWest Cable & Telephone Corp. is not responsible for the forwarding of email sent to any account which has been suspended or terminated. Such email will either be returned to sender, ignored, deleted, or stored temporarily at CityWest Cable & Telephone Corp.'s sole discretion.


5. Newsgroups

CityWest Cable & Telephone Corp. reserves the right to discontinue access to any Usenet newsgroup at any time and for any reason.

The Usenet news service is included with a Cable Internet service account using any available NNTP client such as Netscape Communicator, Outlook Express, Internet Explorer, Free Agent, and WinVN.


6. Internet Relay Chat

The Cable Internet services may be used to participate in Chat discussions hosted by Cable Internet servers, third party servers, or may not involve servers at all. In all of the above mentioned cases CityWest does not monitor the contents of the discussions and is not liable for the contents or actions stemming from the use of Internet Chat via Cable Internet service.

Chat flooding is prohibited. Flooding is defined as deliberately repeating actions in quick succession for the purpose of filling the screens of other Internet users with text.

Any computer or other device that is connected to the Cable Internet services may not maintain more than 2 simultaneous chat connections. Bots, clones, and other automated devices are prohibited in the absence of the user physically being present at the device.

The Cable Internet service may not be utilized to send messages which will disrupt another Internet user's equipment, including but not limited to hardware, software and the user's display.

The Cable Internet services may not be used to access any server in violation of the acceptable usage policy of that server. The Cable Internet service may not also be used to manipulate any chat server for the purpose of harassing or disconnecting other Internet users, or to gain access to privileges which you have not been authorized to you.

The Cable Internet services may also not be used to connect the user to channels which they have previously been banned or "kicked" from.

The Cable Internet service may not be used to continue to send chat message to an Internet user who has indicated their desire to not receive messages.

Forging, altering, or obscuring your identity while participating in chat sessions is forbidden. You may use a nickname provided that all participants may discover your real name via normal Internet conventions, such as the whois command, or within the chat program they are using.


7. Bandwidth, Data Storage and Other Limitation

You must comply with the current bandwidth, data storage and other limitations on the Cable Internet service. Usage of third party accelerators is strictly prohibited.

Users must ensure that their usage does not improperly affect, inhibit, restrict, or degrade any other customer's use of the Cable Internet service. Users may not place an unusually large burden on the network itself. Users must also ensure that their activity does not improperly restrict, disrupt, inhibit, degrade or impede CityWest Cable & Telephone Corp.'s ability to deliver the Cable Internet service and monitor the service backbone, network nodes, and/or other network services.

Customers may not resell, share, or otherwise distribute the Cable Internet service or any portion thereof to any third party without the written consent of CityWest Cable & Telephone Corp. For example you cannot provide Internet access to others via a dial-up connection, host shell accounts over the Internet, provide email or news services, or send a news feed.

The Cable Internet service is designed for personal Internet use. You may not use the Cable Internet service for commercial purposes unless you have purchased a Small Business connection or Commercial account with CityWest Cable & Telephone Corp. You may not use the Cable Internet service to run a server without written consent from CityWest Cable . This includes CityWest Small Business and Commercial Internet accounts. Examples of prohibited programs include, but are not limited to, mail, http, ftp, irc, dhcp servers, and multi-user interactive forums.


8. Violation of Acceptable Use Policy

CityWest Cable & Telephone Corp. does not routinely monitor the activity of accounts for violation of the Policy. However, in efforts to promote good citizenship within the Internet community, we will respond appropriately if we become aware of inappropriate use of the Cable Internet service. Although CityWest Cable & Telephone Corp. reserves the right to monitor bandwidth, usage and content from time to time, to identify violations of the Policy and/or to protect the network and Cable users.

CityWest Cable & Telephone Corp. prefers to advise customers of inappropriate behavior and provide corrective actions. If the Cable Internet services are used in a way which CityWest Cable & Telephone Corp. , in its sole discretion, believes violates this Policy, CityWest Cable & Telephone Corp. may take any responsive actions they deem appropriate. Such actions include, but are not limited to, temporary or permanent removal of content, cancellation or newsgroup posts, filtering of Internet transmissions, and the immediate suspension or termination of all or any portion of the Cable Internet service. CityWest Cable & Telephone Corp. may take other legal or technical action it deems appropriate.

CityWest Cable & Telephone Corp. reserves the right to investigate suspected violations of this Policy, including the gathering of information from the user or users involved and the complaining party, if any, and examination of material on Cable Internet servers and network. During an investigation CityWest Cable & Telephone Corp. may suspend the account or accounts involved and/or remove material which potentially violates the Policy.

You hereby authorize CityWest Cable & Telephone Corp. to cooperate with both law enforcement authorities in the investigation of suspected criminal violations and system administrators at other Internet service providers or other network or computing facilities in order to enforce this Policy. Such cooperation may include CityWest Cable & Telephone Corp. providing the username, IP address, or other identifying information about a subscriber.

Upon termination or an account, CityWest Cable & Telephone Corp. is authorized to delete any files, programs, data and email messages associated with such an account.

The failure of CityWest Cable & Telephone Corp. to enforce this Policy, for whatever reason, shall not be construed as a waiver of any right to do so at any time.

You agree that, if any portion of this Policy is held invalid or unenforceable, that portion will be construed consistent with applicable law as nearly as possible, and the remaining portions will remain in full force and effect.


9. Illegal Cable Services

You agree that you will not install or add any unauthorized splitters in the cable line to the modem. This is an illegal activity and will not be tolerated in conjunction with the Cable Internet service. Failure to comply with this rule will result in immediate cancellation or services.
